Klehr, Harrison is counsel to the Official Parents Compensatory Education Funds Committee (the “Parents Committee”) in the Einstein Cyber Charter School (“Einstein”) Chapter 11 case. In conjunction with the order of the Bankruptcy Court in the Einstein Chapter 11 case approving the joint disclosure statement relating to the joint liquidating plan of reorganization (the “Plan”), September 18, 2007 has been established as the deadline to vote to accept or reject the Plan.
The Parents Committee has engaged the services of an administrator for the purpose of evaluating, reconciling and making distributions on account of allowed compensatory education claims. The email address of the administrator is comped4kids@comcast.net.
In order for compensatory education claims against Einstein to become allowed claims and therefore be entitled to a distribution from the funds maintained by the Parents Committee for that purpose, claimants must produce certain documentation evidencing their entitlement to reimbursements for materials and/or services which Einstein was obligated to provide but did not.
This documentation will include, at a minimum, IEP information applicable to each claimant for the period of time in which the claimant was enrolled at Einstein and which reflects the claimant’s entitlement to compensatory education benefits. The administrator may, in her discretion, require the submission of information and/or documentation in addition to IEPs, including information concerning particular expenditures made by or on behalf of compensatory education claimants for materials and/or services which Einstein was obligated to provide but did not.
ANY PERSON ASSERTING A COMPENSATORY EDUCATION CLAIM AGAINST EINSTEIN MUST CONTACT THE ADMINISTRATOR AND DELIVER PROOF OF SUCH CLAIM ON OR BEFORE SEPTEMBER 18, 2007 AT 5:00 P.M. (PREVAILING EASTERN TIME). THE FAILURE TO DO SO MAY PRECLUDE THE HOLDER OF A COMPENSATORY EDUCATION CLAIM FROM RECEIVING ANY DISTRIBUTION ON ACCOUNT OF SUCH CLAIM.
The Parents Committee urges each compensatory education claimant to review the Plan in detail, including specifically those provisions which deal with the rights of compensatory education claimants.
