Arrow Trucking Employee Update

All Arrow Trucking Employees Represented by Klehr Harrison
Charles A. Ercole
January 21, 2010
As you are aware, we first filed a Complaint in Federal District Court seeking damages for the WARN Act as well as unpaid wages, medical premiums, 401K contributions, child support payments and withholding taxes that had not been forwarded to the appropriate parties. Subsequently, on January 8, 2010 Arrow filed for bankruptcy and we have since filed a new Complaint in the bankruptcy. We have also named Doug and Carol Pielsticker as defendants in that litigation.
We are interviewing employees and witnesses daily and conducting an investigation into the ongoings at Arrow Trucking. We expect that this will be a difficult litigation and it will take a significant effort to uncover all the assets that may have been moved in and out of Arrow Trucking – – that should have gone to employees instead.
On February 8, 2010, there will be an initial meeting of the creditors in Tulsa. We will be in court that day representing employees and hope to get some information from the bankruptcy trustee about the known assets and the plan for uncovering all the assets.
We will provide these updates on a periodic basis. If there is nothing significant to report, the intervals between updates may be longer. Conversely, if there are important developments that we believe would be of interest, we will issue more updates. Regardless, we intend to vigorously prosecute this case and we will keep you apprised of all future developments.
Thank you.
