Charles A. Ercole, of Klehr, Harrison, Harvey, Branzburg & Ellers LLP today filed a class action lawsuit in federal court in Richmond, Virginia against Qimonda AG and related entities alleging violations of the Worker Adjustment and Retraining Notification Act (“WARN Act”) because they laid-off over 1,000 employees on or about February 4, 2009 without providing 60 days notice.
The lawsuit, Lakita Blair, Linda Frazier and Bonnie Wright v. Qimonda AG, Qimonda North America, and Qimonda Richmond, LLC asks for class action status to pursue the claims on behalf of all employees who were laid-off. The lawsuit seeks 60 days wages, fringe benefits, interest, penalties, and attorneys’ fees. At the time of filing, over 165 employees had signed individual engagement agreements with Klehr Harrison.
