Chuck Ercole Represents McFadden's in Discrimination Case

Charles A. Ercole and Klehr Harrison Harvey Branzburg LLP have been retained to defend and represent the Defendants in the lawsuit filed this week by employee, Michael Bolden, (Michael L. Bolden v. East Coast Saloons, LLC and Miriam’s Kids D/B/A McFadden’s Restaurant and Saloon 2:10-cv-06121-PD (EDPA).

In response to the Complaint, Mr. Ercole said “McFadden’s denies that Mr. Bolden was ever discriminated against and further denies that it ever implemented policies specifically intended to preclude patrons of any race. McFadden’s intends to vigorously fight the false allegations set forth in Mr. Bolden’s Complaint and looks forward to being fully exonerated in Court. While we do not intend to respond to each allegation now, we would like to address a couple issues. First, Mr. Bolden’s bartending assignments and compensation are equal to [or better than] other bartenders of his experience level and productivity at McFadden’s. The assignments are in no way based on race. Additionally, the decision to discontinue the Wednesday night promotions was not based on race. There were multiple incidents of fighting and other disturbances that resulted in the involvement of the Philadelphia Police. As a result, a decision was made to discontinue the promotions.

Lastly, McFadden’s is conducting a thorough investigation concerning the text messages allegedly sent by a manager at McFadden’s. McFadden’s finds the language in those text messages offensive and reprehensible. The manager has been suspended pending the outcome of that investigation.”
