Biography
Scott focuses his practice on commercial litigation, subrogation, recovery and collections, construction law and related real estate matters, bankruptcy litigation and a broad range of creditors’ rights issues, insurance coverage disputes, products liability matters and property/casualty matters. He regularly appears in both federal and state courts, where he litigates a wide scope of matters. He is particularly skilled and adept at managing all phases of litigation, from inception through trial. Scott also regularly handles arbitrations and mediations. Clients rely on his ability to creatively structure and implement settlements in order to resolve commercial disputes efficiently.
Prior to joining the firm, Scott was a partner in the Philadelphia office of a national law firm, where he built a strong track record of litigating commercial disputes across an extensive range of industries.
Outside the office, Scott volunteers as jazz coordinator for Lehigh Valley Community Radio (WDIY) and hosts All Star Jazz for the station on the third Wednesday of each month.
A sampling of representative matters includes:
- Pursued multi-layered recovery effort on behalf of a major educational institution against its former securities broker, beginning with confirming a FINRA arbitration award into a state court judgment, collecting some funds within the state court proceeding through post-judgment enforcement efforts, and then following the broker into Bankruptcy Court and taking necessary action to preserve and protect the creditor’s rights, ultimately leading to a distribution resulting in the recovery of the entire multi-million dollar judgment balance, including all accumulated interest.
- Successfully advanced litigation within a television personality’s bankruptcy proceeding, reaching an amicable court-ordered settlement of the adversary proceeding after conducting numerous depositions and uncovering relevant details about the disposition of the debtor’s earnings and other assets.
- Obtained a Bankruptcy Court order declaring debt owed to bonding company by construction contractor’s personal indemnitors as non-dischargeable due to the debtors’ defalcation of funds, then engaged in extensive post-judgment enforcement proceedings, pursuing the judgment debtors through additional bankruptcy proceedings and a residential real estate foreclosure action, culminating in a state court judgment directing the payment of surplus funds generated by the sale of the real estate to be paid towards satisfaction of the non-dischargeable judgment.
- Represented construction contractors in a state court breach of contract action against an institution for non-payment of services, and after entering judgment against the institution, conducted supplementary proceedings to enforce the judgment, culminating in the creation of a holding company with numerous other judgment creditors and filing a motion to compel a Sheriff’s sale of the judgment debtor’s real property, resulting in an amicable settlement in which all judgment creditors were made whole.

Experience
Commercial Litigation
- Managed multi-state litigation on behalf of a major hotel brand, focusing on landlord-tenant issues and other matters concerning hotel operations.
- Proceeded with lawsuits against notaries whose notarial acknowledgements were challenged by the purported signers of key contractual documents, leveraging settlements after conducting the depositions of the notaries.
- Through court-annexed mediation, successfully negotiated the resolution of a dispute between a corporate catering company and an audiovisual contractor for work performed at a high-profile international facility.
- Routinely enforced contractual indemnification agreements through litigation in state and federal courts (including bankruptcy courts), and aggressively pursued judgment debtors in post- judgment enforcement proceedings.
Bankruptcy Litigation
- Resolved claims brought by state court systems for performance of contractual obligations related to the creation of the courts’ computer software systems and preserved and protected creditor’s rights within software development company’s bankruptcy proceeding.
- Served as Special Counsel to the Debtors within their bankruptcy proceedings, filing adversary proceedings to recover contract balances owed to the Debtors for pre-petition construction work performed by the Debtors.
- In a matter involving the disposition of pre-petition funds that were paid into escrow in consideration of a reduction in criminal sentencing for the Debtor, advanced creditor’s rights within the Debtor’s subsequent bankruptcy proceeding, negotiating resolution with counsel for the Chapter 7 trustee to resolve an appeal of the Bankruptcy Court’s order regarding turnover of escrowed funds.
Collections/Subrogation
- Recovered over $1 million balance of employer’s funds that were improperly retained by an authorized agent by successfully filing suit and entering judgment against the authorized agent, and then aggressively enforcing the judgment against the agent’s assets.
- Proceeded with action in state court against a former executive of a large national corporation who embezzled funds from her former employer, and after entering judgment against the former executive, reached a settlement after filing a petition to cause the Sheriff’s sale of the former executive’s residential real property.
- Represented statutory liquidator of an insurance company, and filed action to recover funds from insurance broker for outstanding premiums owed in accordance with Agency Agreements, resulting in amicable resolution prior to trial.
- Managed multi-state portfolio of collections matters for numerous institutional clients.
- Achieved settlement on judgment balance owed by corporate judgment debtor after bringing action against successor company/alter ego of the judgment debtor based on facts developed during supplementary proceedings of judgment debtor.
Construction
- Successfully conducted a bench trial in Queens Supreme Court on behalf of a bonding company defendant, resulting in a “no cause” decision following the presentation of a motion for directed verdict at the close of trial.
- Negotiated settlement of multi-million-dollar performance bond claim for costs of completion of apartment building through extensive mediation efforts.
- Served as trial counsel for a bonding company in a federal jury trial brought by a subcontractor seeking a balance allegedly owed for construction work performed in connection with a public works contract, and leveraged an oral motion made during the trial into settlement discussions that resulted in a settlement being reached before the jury was charged.
- Served as trial counsel to defend bonding company within class action trial brought by laborers claiming not to have received payment of prevailing wages/benefits for construction work that they performed for bonded contractor, and reached amicable resolution of matter following jury trial.
