Join Lee Sussman and Dan Grabell as they explore the drafting and negotiation of commercial leases, with an emphasis placed on building exit strategies into a lease before the tenant signs on the dotted line. Such protections are critical to providing flexibility in meeting future needs and safeguarding against a volatile economy and/or the failure of a business. Key issues to be discussed include the following: (i) assignment and subletting, permitted transfers and releases of liability, (ii) permitted and prohibited uses, (iii) continuous operations and going dark, (iv) co-tenancy and kick-out clauses, (v) early termination and partial contraction rights, and (vi) limited guarantees.
