With continuing high interest rates, tight credit standards, elevated capitalization rates, inflation eroding cash available for rents and retail purchases, marketplace uncertainty, work from home, web shopping, fear that formerly hot asset classes like industrial warehouses are over built and other factors,  real estate values have been challenging across virtually all asset classes. In addition, many properties recently traded at prices that were priced for perfection and they are facing assessment challenges from School Districts across Pennsylvania. Other School Districts are attempting to find undervalued properties that have not sold recently, and questions are being raised as to whether those districts are complying with the PA Supreme Court’s holding in Valley Forge. In addition, the Supreme Court has agreed to review the appeal standards of a School District where each side will be pressing the court to “clarify” Valley Forge to conform to its conception of that case’s requirements. In addition to the legal uncertainty, all too often, these School Districts and their appraisers have their sights set on the rear view mirror. Finally, many appraisers continue to rely on market assumptions that are not supportable, leading to overvaluation, and other appraisers may skew low but without proper support.

In this CLE, Larry AremMatthew McHugh and Michael Phillips will address filing challenges against real estate assessments in Pennsylvania and defending School District appeals based upon a School District’s alleged failure to follow Valley Forge or where the owner believes that the School District has an overinflated view of a property’s value.
