Biography

Josh is a skilled and experienced litigator whose practice focuses on complex civil litigation and business disputes, including contract and business tort actions, business divorce, real estate and financial services litigation, and secured lending and preferred equity investment matters. He is especially adept at defending clients in consumer fraud individual and class actions, including claims for violation of the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, the Pennsylvania Unfair Trade Practices and Consumer Protection Law, the New Jersey Consumer Fraud Act, and the New Jersey Truth in Consumer Contract, Warranty and Notice Act.

Josh has deep experience in all aspects of civil litigation, including first- and second-chair trial and arbitration experience. Josh has advocated for his clients at all levels of federal and state courts throughout Pennsylvania, New Jersey and across the country. He has also handled appeals before the Third Circuit, the Pennsylvania Superior Court, and the New Jersey Appellate Division and Supreme Court. 

A member of the firm’s labor & employment team, Josh frequently represents businesses and individuals in actions to enforce restrictive covenant agreements, discrimination claims brought under the full range of EEO statutes and state common law, including Title VII, the ADA, the ADEA, and the FMLA, and trade secrets litigation in state and federal courts. In his employment practice, Josh has both obtained and successfully opposed temporary and preliminary injunctions and has significant experience defending and advising clients in connection with wage and hour collective actions.   

Josh is also a member of the firm’s construction industry group. He regularly advises and represents owners and general contractors in a wide range of development and construction matters and litigation, including municipal construction, commercial, mixed-use and residential development projects, and mechanics’ lien and eminent domain actions.

Josh understands that no two clients or cases are the same. He prides himself on finding pragmatic solutions and crafting the right approach to put his clients in the best possible position based upon their unique business needs and goals. Sometimes the best results are not achieved in a courtroom. However, when a trial is required, Josh has tried and arbitrated numerous cases to verdict—successfully.

A native Philadelphian, Josh now lives in Yardley with his wife and two young sons.

  • Representation of an industry-leading special servicing company in complex commercial real estate litigation involving multiple developers of high-visibility downtown property and the City of Charleston, West Virginia.
  • Representation of a national jewelry retailer and leveraged motion for judgment on the pleadings to obtain voluntary dismissal with prejudice of claim for violation of the Fair Credit Reporting Act. 
  • Defended a venture capital funded digital advertising company and obtained a favorable settlement in action for wrongful discharge and denial of severance brought by the company’s former chief revenue officer. 
  • Representation of an international restaurant chain and secured general contractor’s voluntary dismissal of claims with prejudice in litigation arising from the construction of a retail restaurant location in the East Falls section of Philadelphia. 
  • Representation of an international automobile company and obtained summary judgment on claims for violation of the New Jersey Lemon Law Act, New Jersey Consumer Fraud Act, and federal Magnuson Moss Warranty Act.
  • Defended national bank against claims under the Uniform Commercial Code and secured dismissal of the complaint with prejudice on motion to dismiss.
  • Representation of an industry-leading mobile banking services provider and developed creative defense strategy leading to the plaintiff’s early voluntary dismissal of all claims with prejudice. 
  • Representation of an industry-leading special servicing company and won summary judgment against guarantors of multi-million dollar commercial loan for violation of the non-recourse exceptions in the loan agreement. 
  • Representation of a nationwide insurance company and secured low-value settlement following briefing of motion to dismiss in a putative class action for violation of the Telephone Consumer Protection Act.
  • Secured landmark class-action settlement on behalf of visually impaired, low-income residents of New York City in action for violation of the Americans with Disabilities Act.
