Corinne Brennan

Cori concentrates her practice in commercial and consumer bankruptcy, reorganization, workouts, foreclosure litigation, regulatory matters related to consumer finance, and general consumer and commercial litigation.

Cori has more than a decade of experience representing secured lenders, creditors, committees, equity security holders, and trustees in all facets of commercial and consumer bankruptcy proceedings, including contested matters, adversary proceedings, and appeals. Representative matters in bankruptcy include counseling both plaintiffs and defendants in preference litigation, fraudulent transfer actions, and dischargeability challenges.

Her workout practice includes the representation of national and regional banking institutions, credit unions, private equity firms, and high net-worth individuals in unique out-of-court financial reorganizations that require a combination of restructuring, transactional, and litigation expertise. Her diverse state court representative matters include receiverships, assignments for the benefit of creditors, quiet title actions, and commercial and residential foreclosure proceedings. She has also represented clients in both the prosecution and defense of a wide variety of commercial claims, such as complex contract disputes, business torts, confessions of judgment, and fraudulent transfer actions.

Cori’s financial services practice also includes the regular provision of counseling to her clients on regulatory compliance and due diligence matters under the Equal Credit Opportunity Act (ECOA), Real Estate Settlement Procedures Act (RESPA), Truth in Lending Act (TILA), Fair Credit Reporting Act (FCRA) and Fair Debt Collection Practices Act (FDCPA). She has successfully defended clients against claims and counterclaims based on alleged violations of these and other laws and frequently conducts in-house training seminars related to these topics.

• Represented a commercial landlord in a landlord-tenant dispute, wherein a preliminary injunction was obtained on behalf of property owner client prohibiting defendants from operating unauthorized lodging in almost twenty units on the plaintiff’s premises, where defendants’ unlawful subtenants were engaging in illegal activities in violation of lease agreement
• Represented financial institution in an out-of-court commercial workout with a property holding company, which resulted in the structured liquidation of several historic properties and full repayment of the debt to the client, including default interest and all attorneys’ fees and costs totaling approximately $2 million
• Obtained a dismissal of a six-count preference and fraudulent transfer complaint on behalf of a corporate creditor in defense of an adversary proceeding, resulting in zero overall liability for the client
• Represented a financial institution in an out-of-court commercial workout with a property holding company, which resulted in the structured liquidation of several multi-family properties, refinancing of a half dozen credit facilities, and full repayment of the debt to the client, including all attorneys’ fees and costs
• Represented a commercial tenant in a landlord-tenant dispute, wherein the landlord’s preliminary injunction was denied in a first action, and a confessed judgment was opened in a second action
• Led the successful prosecution of a highly contested multi-million dollar commercial mortgage foreclosure action through trial, which ultimately resulted in the entry of a verdict and judgment in favor of a private equity client
• Effectively represented a lender in connection with a major check kiting operation that defrauded multiple banks of over $10 million
• Represented a Fortune 500 company in a complex collections action against a guarantor, resulting in a favorable seven-figure settlement
• Assisted a financial institution in formulating a strategy and response to a federal regulatory investigation related to alleged violations of consumer lending laws, which resulted in a closure of the investigation without a finding of liability
