As reported in the October 21 client alert, the Equal Employment Opportunity Commission (EEOC) recently released the “Know Your Rights” poster, which certain employers (the Covered Employers) are required by federal law to prominently display at their work sites. The Covered Employers include most private employers, state and local government employers, education institution employers, unions, and staffing agencies. The day after the poster was released, the EEOC issued a revised version entitled, “Know Your Rights: Workplace Discrimination is Illegal” which supersedes the poster released on October 19, 2022.
Yesterday the EEOC issued a fact sheet answering frequently asked questions concerning the poster. Among other things, the fact sheet clarifies that there is no specific deadline for replacing the “EEO is the Law” poster, but urges employers to “remove the old poster and display the new one within a reasonable amount of time.” The EEOC also advised that it does not provide printed copies of the poster, but it can be downloaded and printed from the EEOC website. In accordance with the Americans with Disabilities Act, the poster is also available in a format optimized for screen readers.
