PHILADELPHIA (June 26, 2024) – Klehr Harrison Harvey Branzburg LLP is excited to announce the formation of a formal appellate litigation practice group. The practice will be led by litigation partner Glenn Weiner. The announcement comes on the heels of several prominent successes at the appellate level. In April, Glenn Weiner and Michael Phillips argued four appeals on the same day in the Commonwealth Court of Pennsylvania on zoning and land use matters, all of which recently received favorable decisions.
“The appeals process can be a complicated road to navigate, and the outcome can be significant for the client,” said Weiner. “Our team has extensive experience with high-stakes appeals in both state and federal courts, not only in our ‘home courts’ but also across the country.”
In the last three years alone, Grant Phelan, co-chair of the Litigation Department, has argued or was lead counsel on matters on appeal in the states of Arizona, California, Maryland, Michigan, Minnesota, New York, Ohio, Pennsylvania and Texas, as well as before the U.S. Court of Appeals for the Ninth Circuit.
“This is an exemplary group and we’ve seen frequent successes in our matters facing appeal,” added Jonathan Krause, co-chair of the Litigation Department. “Formalizing the practice group will allow us to expand our focus on this important, and often necessary, part of the legal process.”
While the team has distinct expertise in zoning and land use-related appeals, the firm has appellate experience in a wide range of matters. In a case challenging the constitutionality of the City of Philadelphia’s reassessment of only commercial properties, our team obtained a fully favorable decision in Duffield House Associates, L.P. v. City of Philadelphia and consolidated cases. The unprecedented decision required the City to refund as much as $63 million to commercial property taxpayers. Weiner, as lead counsel on appeal, argued the cases on behalf of the group of taxpayer counsel, successfully defending the trial verdict before the en banc Commonwealth Court. The team also recently briefed and argued an issue of first impression before the Pennsylvania Supreme Court with respect to whether a plaintiff in a Pennsylvania securities fraud action has the obligation under section 1-401(b) of the Pennsylvania Securities Act to plead and prove intentional misrepresentation, resulting in a favorable decision for the client.
Weiner concentrates his practice on business litigation, with a particular emphasis on appellate litigation. His work earned him the distinction of being named a Stand-out Attorney by Thomson Reuters. He has argued appeals in every appellate court in the tri-state area and several other courts around the country. He represents clients in a wide range of matters, including disputes involving governance of corporations and alternative business entities, and contract, employment, fiduciary duty, real estate, real estate tax assessment and uniformity issues, securities, trademark infringement, trade secrets, zoning, and other business tort matters.
He received his J.D. from the University of Virginia School of Law and his B.A. from Amherst College, magna cum laude.
